' 1 This was an application for order of adjujt' dication and meeting of creditors. The order was made, the meeting of credits! tors to be held on Wednesday, Jan, 20, at the (■;; Assembly Rooms, Timaru. RE ARTHUR WARD. ~ Mr Joynt for the insolvent. " The order for adjudication and meeting of '.'i creditors was made, the application to be dated Jan. 5, 1869.
In Banco. BE HENRY GEORGE BDRNELL, DECEASED. Mr Wynn Williams for the applicant. This was an application for leave to issue probate of the will of the deceased to Edward Preston, the executor in New Zealand, there being another executor in England. The order was made to Edward Pre?ton, the executor named in the will, confined to New Zealaad. GRAHAM AND ANOTHER AT THE SUIT OP LANCE. This case was postponed for further hearing. PROCEDURE IN DIVORCE CASES. Mr Joynt asked his Honour whether the rules of procedure in divorce cases had yet been received, and, if not, when might be expected ? He made the application because he had two pressing cases in hand. One waß divorce, which could only be heard before three judges. The other was for a judicial separation on account of gross cruelty on the part of a husband towards his wife. The husband was already undergoing imprisonment for similar acts, and his wife dreaded a repetition of violence on his re-
His Honor said that he had not yet received the rules in question, although he had expected to have done so ere this. The rules, which were very long, were left in MrJustiee Johnson's hands for revision for the press. They were merely an echo of the English ones. H() thought that Mr Joynt could proceed in the latter case he had mentioned without waiting for the rules.
