DAMAGES CLAIMED
VERDiCT FOR PLAINTIFF
' A verdict for tho plaintiffifor''sß2o2 6s special damages and £250 general damages was returned by the jury yesterday afternoon in the Supreme Court case in which James Grey Wight, labourer, claimed in all £1202 from the Cunningham Carrying Company.- The claim was a sequel to an accident which occurred on the Western Hutt road in October last.
It was stated by tho foreman that the jury considered/the defendant company's driver was negligent in failing to make certain, that the plaintiff (who was crushed against a bank) had reached safety. '. . ■ Mr. P. J. O'Rjegan moved for judgment for the plaintiff. Mr. E. Parry, who had previously 'asked for aionsuit on the ground that there was no evidence to go to the jury, tho point being reserved, moved for judgment for the defendant on the ground that on. the whole of the evidence tho jury could not reasonably find for the plaintiff. . His Honour, Mr. Justice '""Reed, deferred consideration of the points raised till Monday morning next.
