CASE ON APPEAL
DAMAGE TO BILLIARD BOOM.
This afternoon his Honour Mr. Justice Hosking continued the hearing of the appeal from the decision of Mr. W. G. Riddell, S.M., in the case of Albert Edward Hugh and! James Kirk, billiard saloon proprietors, v. George Scott, trading as the Scott Motor Agency, Dixonstreet, Wellington. The plaintiffs^ claimed and were awarded damages in the Lower Court by reason of their premises being flooded out and damaged by the negligence of the defendant, whose premises adjoin those of the plaintiffs. At the hearing of the appeal yesterday andi to-day, Mr. T. Young appeared for the appellant, and Mr. G. G. Wateon for the respondents. Legal argument was proceeding when The Post went to oress.
