WEIjLINGTON CITY TRADING DEPARTMENTS' RESERVE AND RENEWAL FUNDS BILL. ArOTJCK Jfl HEREBY GIVEN that ij. Is £S the intention of the Wellington City Council to introduce in tho ensuing hesslon of Parliament, tho WeUington City Trading Departments' Reserve and Renowal Funds Bill. The objects that the said BUI is intended to effect flie:— 1. To provido that, the Council may establish renewal funds in connection mtu the Abattoir Undertaking, the Tramway and Power Supply Undertaking, and the Electrio Light and Power Supply Undertaking. 2. For tho purpose of such funds in compiling the annual account* of rnvonuo and expenditure of such undertakings '••" ohargo on annual appropriation to provido renowal funds.' Such appropriation to bo one pound ten shillings per' centum of tho valne of tho depreciable assets of Wo undertaking, and such valuo to bo pen by tho 'City Engineer, whoso decision shall bo final. . 3. To provido that such, o-piroprifltiona shall bo mado independently of charges for maintenance and repairs. t. To provido that Buch appropriations ehall bo paid in .tho month of April m each ..year to Commissioners to be eppointed under tho Act: tho first of sucb payments to bo mado in April. IMS. 6. To provide that three Commissionere, to bo termed "Tho Wellington City Renewal Fund Commissioners,' shall bo a>pproved on the passing of tho Aot, and tbat tho provisions of Sections 35. J6. and 3a of Tio Local • Bodies' Loans Act, 1913, shall, mutatis mutandis, apply as if tno Oommißsionora were appointed under that Act.

6. To provide tha* tho Council shall transfer tho existing Abattoir Renewal Fund, amounting to £2171 os. 4d., and tho .existing Tramway Renewal Fund, amounting to #2,078 Ba. 6d„ to tho Cominission- ' era to be go appointed. 7. To provide that the Commissioners shall invest all monoyß in: (a.) Now Zealand Government securities. (b) On deposit in any ba-nk carrying on business in Now Zealand, under the authority of an Act o£ tho General Assembly. ■ 8. To provido that separate Rcounts Khali bo kept by tho Commissioners In respect of. tho several ,undertakings. 9. To provido that all moneys, together •with all accumulations or interest, shau be held by tho Commissioners on trust to pay to the Council the portion of the fund« standing to the oredit of each ouch undertaking, for I>ho purpose of renewingor replacing tho plant of the undertaking or any part or parts thereof that may from timo to time becomo worn out, obsoloto, or incapable from any other caiißc.of further usefulness. 10. To provido (1) That every demand made by the Council on the Commissioners shall be accompanied by a copy of the resolution of tho Council calling up such moneys, and by a fuU specification of tho works -proposed to be done. (2) Such resolution must state that the money proposed to be called up is required to replaoo plant'? or material that has becomo worn out or • obsolete, or is incapable from any other oausc of further usefulness, and shall be certified by the Mayor and the Town Clerk. (3) That the Commissioners shall not ' pay or refund In respect of any undertaking any amount in excess of tho amount held, by them to the oredit of such undertaking. . 11. To provido \that tho Commissioners may caU for a report by an engineer or other qualified person as to the propriety of any domand mado upon them; that such person shall have the right to inquire into the reasons v&hy tho Council proposes to expend the moneys asked for and into tho nature and extent of the proposed works; that suoh engineer shall report to tho' Commissioners the result of his Investigation and his opinion on tho proposals; and that the Commissioners may pay such person a reasonable sum for his services.

12. To provide that tho Commissioners may pay tho amount demanded by instalments, or may declino to pay suoh money; that in tho latiar case the Council may by summons in Chambers apply to tho 'Supreme Court for an order directing tho Commissioners to pay tho sum demanded; that if the Court is of opinion that the Council has proved that the money required is necessary to replace or renow plant -which has become worn out or obsolete, or incapable from any other cause of further usefulness, the Court may order tho payment of the money to the Council; and that tho decision of the Sunremo Court shall bo final. 13. To provido that if on the maturity of any debentures the Sinking Fund is insufficient to pay tho debentures, tho Council may call up tho Renewal Fund in respect of which the debentures were issued; that the Commissioners may pay • the amount so demanded or may-call for a report on tho financial bearing of the Council's demands, and that the provisions of Sections 10 and U of the Bill (being those summarised in paragraphs 11 and 12 of this notice), ehail apply, mutatis mutandis, to such demands. 14. To provide (1) That the Council may establish Reserve. Funds in resneot of tho Tramway and Power Supply Undertaking, and in respect of. the Electric Light and Power' Supply Uridextaking; (2) That the Council shall charge against the acoounts of such undertaking an annual appropriation of one pound ten shillings per centum of the depreciable assets of fuch undertakings. Such value to bo fixod by tho City Engineer, •whose decision ishaTi bo final. (3) That the Council shall, in the month of April in each year, pay ! suoh appropriations into two scp- . nrate banking accounts, to bo termed "Tramway Reserve Fund Account,", and "Electric, Lighting Roscrvo. Fund Account." (4) That tho moneys paid into such accounts shell bo applied for such extensions and improvements in the undertaking in connection with which tho fund is established as tho Council thinks fits. (5) Tiliat if at any time tho renewal funds created in respect, of either the Tramway and Power Supply Undertaking, or in respect of the F.lectrio Light and Powor Supply Undertaking, shall ho insufficient to moot renewals, tho Council may use any part of tho reserve fund established for the undertaking requiring further renewals, for tho purposes of such renewals. (H That the Council must invest such rcsorve funds (a) In New Zealand Government securities. (W On deposit in any Bank carrying nn business within New Zealand under tho authority o( an Aut of tho General Assembly. 15. To provide (1) That tho Council may establish Accident Funds in connection with Uio Tramways end Power Supply Undertaking, and in connection with tho Electric Light and Tower Supply Undertaking. (?.) That such funds may be UEed to . meet claims lor accidents arising in connection with the Undertaking for which the fund is established. ' H) That tho Council m«v invent, ™di funds on deposit in any Bank carrying on business in Now Zealand under the authority of an .Act of tho General Assembly. A copy of this Bill has been deposited in tho Magistrate's Court, Office, Lainbton Quay, Wellington, and a copy of Hie said Bill has also been deposited at. tho Town ' Clerk's Office, Town Hall, Cuba Street.
