WRITTEN Tenders will be received at this office up till NOON on WEDNESDAY, the 15ih October, 1879, for the above contract. They must be addressed to the Hon. the Minister for Public Works, Wellington, and marked outside " Tender for Kaiwarra Contract." Plans and specifications may be seen at the Public Works Offices, Wellington, on and | after WEDNESDAY, tbe 3rd September, and at Auckland, Napier, Chiistohurch, Dnnedin, and Invercargill, on the arrival of succeeding mail after that date. Te'egraphic tenders, similarly addressed and marked, will be received if presented at any Telegraph office by noon of the same date, provided that written tenders in dae form are lodged at any of the abovenamed offices by the same hour, and accompanied by a cheque on some bank in the town where the tender is lodged; such cheque to be specially marked by a banker as good for twentyone days, and to be in favor of the ReceiverGeneral's Deposit Account only, and not to bearer or order. Present r His Excellency tbo Governor in Council; WHEREAS by section twenty-nine of the Public Works Act, 1876 (hereinafter referred to as " tbe said Act"), it is enacted that, if it is found that any land taken under .that Act is not required for public use, the Governor may,, by an Order ,'in Council publicly notified ana gazetted, cause the same to be sold under the conditions therein set forth: And whereas by the ninety fourth section of the said Act it is enacted that the land occupied by any road stopped as provided by the eaid Act shall be dealt with as provided by the twentyninth and following sections of the said Act in the cose of land not required for public use: And whereas the road, the land occupied by which is described in the schedule hereto, has been stopped under the authority of the said Act: ' And Whereas {the Road Board of the Bakaia Boad .District has laid before-the.. Governor the memorial referred to in the twenty-ninth section of the said Act, praying the ,Governor, by an Order in Council, to cause such land to be sold; Now. therefore, I Sir Herculea George - tobert Robinson, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise aud'pursuauce of the powers and authorities aforesaid, do hereby order and. authorise the land described in the schedule hereto to be sold and dealt with in the manner and Bnbject to the conditions of the twenty-ninth and following sections of tbe said Act. All that piece or parcel of land- containing by admeasurement three (3) acres two (2) roods and twenty-one (21) poles, more or less, being the road forming the south-eastern boundary of section numbered ten thousand eight hundred and eighty-nine (10859), in the Hawkins Survey District, Rakaia Road District, County of Selwyn. Bounded towards the south-west" and north-west by section numbered ten thousand eight hundred and eighty-nine (108S9) three thousand eight hundred |38Q0) links; towards the east by a road line two hundred and twentynine (229) links ; towards the south east and north-east by Crown land, .three thousand four hundred and sixty-three (3463) links; and towards the south by the River Hororata.; be all the .aforesaid _ linkages more or less; the above particulars being delineated on the map attached tie memorial referred to.
