SUPKEME ; COURT - SEQITB£>. HEAVX DAMAGES CLAIMED. Damages amounting to i £890 were claimed before Mr. Justice Blair and a jury in the Supreme Court to-day, as the seqpe) to at collision between two motor cars at the corner of Avenue Road and Panmurci Road on September 21. Herbert G. Rae and Myrtle Rae, of Otaliuhu (Mr! McLiver) were plaintiffs against John H. Corbett and Alfred Winder, motor proprietors, of Thames (Mr. Garland). A sum of £700 was claimed as general damages, the remainder being for damage to the car, loss Of its use, and medical expenses. Mr. McLiver said when plaintiff approached the corner he saw a service car, owned b/ defendants, coming from the opposite direction. It ha,d blinding headlights, and some idea of its speed could be -gathered from the faqt that plaintiff's car was struck when halfway across the intersection and driven into a post by the side of the road. Mrs. Rae's eye was injured permanently, though fortunately a considerable improvement had taken place, ♦Tacts Do Not Lie." Remarking that facts did not lie, even though at times witnesses might do so, My. McLiver said it was upon facts alone that the case would be decided. Plaintiff's car had disc wheels, and one of these was pierced, evidently by the bumper car of the service vehicle. From where the car was first struck to where it came to rest was a distance of 52 feet, and the service car stopped about five yards ahead. Mr. Rae's child was flung through the side curtains with such violence that a wooden stay was broken. The child was unconscious for two days. Plaintiff, in evidence, said lie sounded the horn of his car- He maintained that his approach could be seen plainly, because at the corner there was a powerful clecj trie lamp. Witness was travelling on his proper side. The evidence of several eye-witnesses was then taken. The case, which is still proceeding, is expected to last for' some time.
