In banco this morning there was heard the appeal by Messrs Pilcaithley and Co. against the decision of Mr Haselden, S.M., directing them to pay £.-', damages to Mr L. Thacker for refusing to carry him from Lvttelton to O'Kain's Bay at the usual fare, viz., 5/. Thacker being, as it was alleged, hostile to this particular line, was charged £1, and on his refusing to pay this sum during the journey, the boat put back and Thacker was landed again at Lyttelton. The case turns on whether-the boat was a common carrier of passengers by wat:r.
