(Bofora Messrs F. L. Prime and F. Maguiro, Justices.) Duusk.—Three persona were punished for this offence. Larceny.—Alfred Henry Smith was charged with the larceny of throe bottles of scent, value 7s, the property of Frederick C. Thomas; also, with stealing a coat, value 20s, the property o! Michael May, on the Hth inst.—Sergeant White said tho prisoner had been convicted on previous charges, but had been allowed to go on giving sureties for his good behaviour—himself In £100, and two sureties in £50. Ho was a very crafty person, and hod sinco been to Newcastle as cook in a small craft; but on returning to Auckland had commenced his old tricks. Prisoner said it was a mania which the spirits exercised upon him.—Throo months' iinprtsonniont with hard labour. Sunday Liquor Traffic—John Retallack, lessoo of tho York Hotel, Newton, was charged with a breach of tho Licensing Act, viz., with selling gin to Mary Byers, William Henry Wigley, and Patrick Hennessey, on Sunday, March 23rd.—Mr Heskoth appeared for defendant, and said that ho was not prepared to plead guilty. Mr' Wigloy and his two friends wont to the York Hotel to dine, and tho liquor was supplied, but no money was tukon.—Sergeant White said tho porsons wore neither bonA Jtdc travellors nor lodgers, and tho men were discovered with the liquor before them. There was an intended sale. — Constable Henry Clark, stationed at Newton, gave evidence. Ho went to tho hotel and saw tho threo prisoners helping thenisolvos to a bottlo of gin, which was before thorn. Mr Wigley said thoy wore thcro by invitation. One of tho party said," We have not paid." Mr Rotallack said, "I know you have not, but you will have to pay for it." The maid lookod in and said, "You aro caught now."—Win. Henry Wigley stated that he and his friends were Invited to supper that evening by Mr Retallack. Thoy had cold roast pork and applo sauce. No one called for tho gin; it was brought in by tho landlord, who treated them to '"keep the cold out," as ho said. To Mr Hcgkeths It was Mr Retallaok's voluntary act; no payment was made. It was, in fact, the' ■ landlord's treat. Patrick Hennessey, deposed that they took suppet in the kitchen. To Sergeant Whito: Constable Clark came in, thought he was another friend coming to partako of roast pork at the invitation of tho cook, a here had bocn a funeral that day in tho Roman Catholic Cemetery. — Constable Bernard accompanied Cobstablo Clark to the hotel, and gave corroborativo ovidence—Mr Hesketh addressed the Bench in dofencd, and showed that tho threo persons wore guests and tho landlord was lawfully entertaining them at his own expense; there was no proof of sale.—Tho Bench dismissed the cage. Patrick Lynch, of the Alexandra Hotel, was charged with three similar offences, viz., with selling-, on tho 20tb instant, beer to Robert Brcwin, whisky to Robei t Skiffln, and liquor to Robert Dawson.—Mr Hesketh appoared in defonco, and on his advice, BHrLynch pleaded guilty— Sergeant White explained tho case Mr Brewin lived a solitary life in tho Domain among his flowers, and as ho did without beer all tho week, he strolled forth on tho Sunday for tho purpose of refreshini? the inner man (laugh tcr).-Fined 20s and oostß.-Theremaining v coses wore withdrawn.
