I Whereas by the Gold Duties Act, 1858, it is i enacted that Certain duties of Customs shall be I collected on all gold exported from the Colony: And 8 whereas by the third section of the Gold Duties Act, 11870, it is enacted that on the first day of January, one thousand eight hundred and seventy-one, certain new duties of Customs shall be collected on all gold I exported from the Colony in lieu of the duties imposed jby the said Gold Duties Act, 1858. And whereas by I a clerical error in the said Gold Duties Act, 18/0, the I first day of October, one thousand eight hundred ana I seventy is inserted therein as the date of the coming I into operation of the said Act, instead of the first day I of January, one thousand eight hundred and seyentyI one : and whereas the Gold Duties Act, 1870, if construed according to the letter, repeals the Gold Duties Act 1858, as from the first of October, one thousand eight hundred and seventy, instead of from the day on which the said new duties are collectable: And whereas the Collectors of Customs have been directed to collect the duties under the Gold Duties Act, 1858 until the first day of January, notwithstanding such clerical error aforesaid : And whereas certain Persons have refused to pay such duties, contending that there is no authority in law for the levying thereof. And whereas, though it is the manifest intention of the Legislature that the duties imposed by the Gold Duties Act, 1858, should be collected until the duties imposed by the Gold Duties Act, 1870, are collectable, that is to say, the first day of- January, one thousand ■eight hundred and seventy-one—yet doubts have arisen as to whether the collection of such duties can be legally enforced by reason of the clerical error aforesaid: , .... „*•„. And whereas, by the one hundred and sixth section of the Custom.. Regulation Act, ISOB, it is enacted that the Governor may from time to time by Proclamation require that the exporters of gold other than gold coin, or their agents, shall notify in such manner and form as shall in that behalf be prescribed, their intention to export the same, and that the Governor may also in like manner from time to time make provision for the examination of exported gold not being gold coin, and respecting the mode of packing and securing the same, and may prohibit the exportation thereof except from specified ports, and generally may regulate and restrict as may seem meet the export of gold other than gold coin ; and that every person who shall knowingly contravene any provision of any such Proclamation shall for every such offence forfeit a sum not exceeding the sum of on 3 hundred pounds, in addition to any other puni;hment or penalty to which he may become liable by reason of such contravention; And whereas by the on c hundred and twenty-third section of the last-mentioned Act it is provided that any goods whatever may by Proclamation or Order of the Governor in Council, revocable from time to time, be prohibited to be exported or to be carried coastwise, and any such prohibition may apply to the whole colony or any part thereof: and if any goods shall be exported from the Colony or carried coastwise contrary to any such prohibition, or bo water-borne to be so exported or carried, they snail )je forfeited ; and that any person offending against the provisions of the said section now in recital, or of any proclamation or order issued in pursuance thereof, shall for eveiy such offence forfeit and pay the sum of live hundred pounds: And whereas by the one hundred and thirty-first section of the said last-mentioned Act it is provided that the Governor may from time to time regulate and restrict the carriage of gold other than gold coin coastwise from one port of the Colony to another ; and that every person who shall knowingly offend against any such regulation shall for every such offence forfeit the sum of twenty pounds: And whereas by the one hundred and forty-sixth section of the said last-mentioned Act it is provided that all gold other than gold coin, whicli shall be shipped or water-borne to be shipped before due entry thereof, and all such gold found in any vessel, boat, or carriage, or upon any horse or other animal, or about the person of any one in charge of any such vessel, boat, carriage, horse, or other animal, or in the possession of any person being conveyed towards the coast of the Colony, or towards any port thereof, or towards any quay, for the purpose of exportation, contrary to any law or regulation for the time being in force relating to the export of gold, shall be forfeited ; and such gold so found in any vessel, boat, or carriage, or upon any horse or other animal, or about the person of any one in charge thereof, respectively, or in the possession of any person, being conveyed as aforesaid, shall be deemed to be conveyed for the purpose of exportation unless the contrary be proved : And whereas it is expedient that on and after the day of publication, hereof all gold included within the interpretation given to the word " gold" by the Gold Duties Act 1858, should be prohibited to be exported or carried coastwise, as hereinafter appears : Now therefore, I, Sir George Ferguson Bowen, G.0.M.G., Governor of New Zealand, with the advice and consent of the Executive Council of New Zealand, and in exercise and pursuance of all powers and authorities enabling me in this behalf, do hereby proclaim and declare that on and after the day of publication hereof no gold shall be exported or carried coastwise, and that this proclamation shall extend to the whole Colony. And with the like advice and consent aforesaid, I do order and declare that the word "gold" when used in this proclamation shall mean and include all such gold and other substances as are included within the meaning given to the word " gold" in the Gold Duties Act. 1858, and be subject to duty thereby. Given under the hand of his Excellency Sir George Ferguson Bowen, Knight Grand Cross of the Most Distinguished Order of St. Michael ahd St. George, Governor and Commander-in-Chief in and over her Majesty's Colony of New Zealand and its Dependencies, and Vice-Admiral of the same, at the Government House at Wellington ; and issued under the Seal of the Colony this twenty-sixth (26th) day of September, in the year of our Lord one thousand eight hundred and seventy.
