CLOSING OF SHOPS.
WELLINGTON, March 1. The secretary of the Labour Department states that the decision givenl by a Timaru Magistrate recently will bo the subject of a Supreme Court appeal. Proceedings in the case""will be brought under Section 25 of the Shops and Offices Act, providing that shopkeepers may ask the Minister to fix ' closing hours "in the evening." The Chief Justice ruled that "evening" means about the / time of sunset. Subsequently Parliament inserted an amendment in the Act defining evening ac a time of day not earlier than 5 o'clqck in the afternoon. The Timaru Magistrate relied on arid gave his decision in accordance with the Chief Justice's ruling, which he hold was not overridden by the legislative amendment. Aga.ihst this the Department is now appealing.
