UNDERTAKING A NUISANCE ' * .' ■ The Supreme Court of Louisiana has set aside an injunction order obtained by one Osborn, an undertaker, against the City of Shreveport, restraining the city from preventing the operation of his business in a residential part of the # city. The Court refers to an ordinance apparently restrictive in this regard, and says: — " Even if that were not the case, and | there were no ordinance upon the subject, we can at present see no sufficient reason why* the residents of the threat- j ened district should not be protected from plaintiff's proposed invasion, under the general provisions of law which safeguards nuisances per se, but against occupations which become nuisances by reason of the inappropriateness of the places in which they are conducted." j The Court makes out a. large indict-! ment against undertaking establish,!!i<"its, in speaking of the business being i\i itself " gruesome " and its " psycho T logical influence" confronting one and his family in their home life, of its tending naturally to depreciation o( values. The Court also speaks of funerals, funeral mourners, funeral music, and unknown dead in the morgue, visitors going there for purposes ol identification, and all of these producing " a depressing effect."
