THE CASE DISMISSED. At the Magistrate's Court, this morning, before Mr R. Beetham, S.M., Alexander Wildey was charged with|„aving, on August 17, delivered to John Savage, Amberley, printed matter of an indecent,immoral or obscene nature, with intent for the same to be distributed, . , . . Inspector Broham conducted the prosecution, and Mr Russell appeared for the defence. Detective Chrystall said that on the afternoon of August 25 he was accosted by Savage in Hereford Street, who placed a pamphlet of an obscene nature in his hand. Witness looked at the bottom and saw the name John Savage there, and also the imprint of Mr Wildey, St Asaph Street. A number of similar pamphlets were discovered on a search being made. Canon Knowles and George Collier gave similar evidence. Detective Cassells said be saw Wildey in reference to the printing of the pamphlets, and was told that he (Wildey) had printed them to Savage's order. Mr Russell submitted that although evidence had been adduced showing that the accused had printed the pamphlcte, no intent to distribute them on his part l*ad been shown by the prosecution. The mere fact of delivery in the course of a sale was not sufficient, but the delivery and the intent of delivery must be proved. The prosecution had proved neither, and there-' fore the case must be dismissed. His Worship dismissed the charge.
