A decision was given by Mr iifartio U.M., 'to-day in a case in which the Corporation Inspector had euraraoned a Chinese fruiterer for Belling rotten fruit. Hie Worship said he waa unable to diatinguieh' the present case from that cited by counsel for the defendant, in which Sir Justice Stephen had held that there must be seizure of the article exposod for sale j then it mnst be condemned by a Justice, when the /person who exposed the article would be liable to a penalty. In this ease thefruifewas seized after it had beenpurchased, therefore there was no offanoa according to the law, and the infermatioa most bo dismissed.
